This Terms of Service and Liability Agreement (“Agreement”) governs all use of the VocalEdge AI website, products, phone agents, AI assistants, demos, or any service provided by VocalEdge AI (“the Company,” “we,” “us,” or “our”). By accessing, subscribing to, or interacting with any VocalEdge AI system, you (“the Client,” “User,” or “Customer”) acknowledge that you fully understand and agree to all parts of this Agreement. If you do not agree, you must immediately discontinue use of our services.

VocalEdge AI provides artificial intelligence tools designed to assist with phone call handling, lead intake, appointment scheduling, follow-up communication, and various business-related tasks. The Client understands that all features are powered by AI technology that may misunderstand information, misinterpret requests, produce inaccurate responses, or fail to handle certain scenarios correctly. Because AI is not perfect and may behave unpredictably, the Client agrees that all information, output, recommendations, messages, answers, bookings, conversations, and actions generated by VocalEdge AI must be reviewed and verified by the Client, and the Client accepts full responsibility for doing so.

The Client acknowledges that VocalEdge AI does not guarantee accuracy, reliability, correctness, uptime, performance, call handling precision, schedule integrity, lead accuracy, or error-free operation. The Client understands and agrees that VocalEdge AI is not liable for any form of damage, loss, or consequence arising from the use, malfunction, failure, inaccuracy, misinterpretation, or miscommunication generated by the AI system. This includes any financial loss, business loss, lost leads, missed appointments, double bookings, incorrect bookings, misinformation, misrouted messages, technical errors, downtime, system outages, API failures, third-party platform issues, integration errors, or any other malfunction, whether expected or unexpected. The Client agrees that if the product fails in any way whatsoever, VocalEdge AI is not responsible for the outcome.

The Client understands that VocalEdge AI integrates with external platforms such as GoHighLevel, Twilio, Vapi, calendar systems, CRMs, email providers, messaging gateways, and other services outside the Company’s control. The Company is not responsible for failures, downtime, outages, bugs, API changes, syncing problems, or errors caused by external services. The Client agrees that all such issues fall fully outside the liability of VocalEdge AI.

The Client acknowledges that all business decisions, customer interactions, scheduling actions, follow-ups, and decisions made based on AI output are entirely the Client’s responsibility. VocalEdge AI does not replace professional judgment and does not provide legal, medical, financial, safety-related, or certified professional advice of any kind. The Client agrees not to rely on AI-provided information as definitive and accepts full responsibility for verifying all details prior to taking action.

By using the service, the Client agrees to indemnify, defend, and hold harmless VocalEdge AI, its owners, employees, affiliates, contractors, and partners from any claims, disputes, damages, complaints, legal actions, losses, or demands brought by any third party as a result of the Client’s use of the AI system, including but not limited to claims involving misinformation, missed appointments, failed communication, lead loss, customer dissatisfaction, scheduling issues, misunderstandings, or operational errors attributed to AI behavior or user misconfiguration.

The Client understands that calls made to or from our AI assistants may be recorded for training, improvement, and quality assurance. By interacting with the system, the Client gives permission for call recordings to be stored and reviewed internally. VocalEdge AI does not guarantee the accuracy of any call recordings or transcriptions.

The Client understands that all payments made to VocalEdge AI are final. The Company maintains a strict no-refund policy. Once payment is submitted or a subscription is activated, no refunds, credits, charge reversals, reimbursements, or proration will be provided under any circumstance. This includes dissatisfaction with the service, incorrect AI behavior, integration difficulties, user error, configuration issues, third-party outages, business changes, poor performance, or any negative outcome related to service usage. The Client agrees not to initiate chargebacks and understands that doing so violates this Agreement.

By subscribing, the Client authorizes recurring billing until cancellation. Cancellation stops future charges but does not initiate refunds for past or current charges. Charges only begin after confirmation with a VocalEdge AI representative, but once started, all payments remain final.

The Client agrees that VocalEdge AI may update or modify these Terms at any time. Continued use of the service after changes are posted constitutes acceptance of the updated Agreement.

This Privacy Policy describes how VocalEdge AI (“the Company,” “we,” “us,” or “our”) collects, stores, uses, and protects information provided by users (“you,” “your,” or “the Client”) when accessing or interacting with our website, AI assistants, phone agents, demo tools, scheduling features, or any service we provide. By using our services, you consent to the practices described in this Privacy Policy. If you do not agree with any part of this policy, you must discontinue use of our system immediately.

VocalEdge AI collects information that you voluntarily provide, including your name, phone number, email address, business information, address, preferences, website form submissions, and any information entered or spoken to our AI assistant. When you call or message our AI system, the content of the call or message may be recorded, stored, processed, or reviewed to improve the accuracy, performance, and reliability of our technology. By interacting with the AI, you acknowledge and agree that your communications may be recorded and used internally. We may also collect technical information such as device identifiers, IP addresses, browser type, time zone information, and interactions with our website for security, analytics, and performance purposes.

We use the information we collect to deliver, maintain, and improve our AI services, set up or customize your AI assistant, schedule appointments, handle communication tasks, process inquiries, provide customer support, improve system behavior, and develop new features. We may analyze call recordings and transcripts to enhance AI accuracy and performance. All information is used solely to operate and improve our services and internal processes. VocalEdge AI does not sell your personal or business information to third parties.

Because VocalEdge AI relies on third-party platforms such as GoHighLevel, Twilio, Google Calendar, Vapi, and other service providers, your information may be transmitted through or stored on such external systems. These platforms have their own security practices and privacy policies. While VocalEdge AI takes reasonable steps to protect your information, you agree that the Company is not liable for data loss, unauthorized access, breaches, outages, delays, errors, or failures caused by these external systems or any entity outside our control. You understand that no online platform, AI system, or digital service is completely secure, and by using our services you assume all risks related to data security, external breaches, or unintended data exposure.

Your continued use of our services indicates your consent for us to process your information as described in this policy. You may request access to or deletion of the information we hold about you; however, such requests do not guarantee removal from third-party systems or backups beyond our control. You may discontinue use of our services at any time, but stopping service does not require or entitle you to any form of refund or credit. All payments are final as outlined in our Terms of Service and No-Refund Policy.

VocalEdge AI reserves the right to modify, update, or revise this Privacy Policy at any time without prior notice. Changes take effect immediately upon posting to our website. By continuing to use our services after changes have been posted, you acknowledge and accept the updated policy.

This Refund and Cancellation Policy applies to all services, subscriptions, products, and AI systems provided by VocalEdge AI. By subscribing to or using any service offered by VocalEdge AI, the Client acknowledges and agrees that all payments made to the Company are entirely non-refundable. The Client understands that VocalEdge AI provides digital and AI-based services that begin functioning and generating value immediately upon activation or configuration, and therefore no refunds, credits, partial refunds, or prorated adjustments will be issued under any circumstance. The Client also acknowledges that dissatisfaction with AI performance, configuration issues, misunderstandings, misinterpretations, unexpected behavior, business outcomes, lack of results, missed calls, scheduling errors, delays, lead loss, or any other negative experience does not constitute grounds for a refund.

By initiating service, the Client agrees to recurring monthly billing until cancellation. Cancellation stops future payments but does not entitle the Client to any reimbursement for past or current charges. The Client is responsible for canceling service before the next billing cycle if they wish to stop future charges. VocalEdge AI does not provide refunds for unused time, subscription overlap, personal business changes, or discontinuation of use. The Client further agrees not to pursue chargebacks through their bank or card issuer, and acknowledges that initiating a chargeback constitutes a violation of this Policy and the Terms of Service. If a chargeback is attempted, VocalEdge AI reserves the right to provide full contractual and billing evidence to the payment processor, pursue collection actions, suspend services, and permanently terminate access.

The Client understands that all payments are final, non-negotiable, and binding as soon as they are processed, and that continued use of VocalEdge AI after reading this Policy constitutes acceptance of these terms.

This Service Agreement governs the ongoing relationship between VocalEdge AI and the Client. By using, subscribing to, or activating any AI assistant, phone service, scheduling tool, or digital system provided by the Company, the Client acknowledges that they are entering into a subscription-based service arrangement that renews automatically until canceled. The Client agrees to provide accurate business information, calendar access, phone numbers, scheduling preferences, service details, and any other data required to configure the AI assistant. The Client understands that the accuracy of the AI’s behavior is dependent on the information they provide, and that providing incomplete, inaccurate, or outdated details may cause errors or failures for which VocalEdge AI bears no responsibility.

The Client acknowledges that the Company does not guarantee performance, accuracy, or uptime, and that all AI behavior, responses, bookings, and interactions must be monitored and verified by the Client. The Client is solely responsible for reviewing scheduled appointments, checking lead details, confirming customer information, and ensuring their business operations remain compliant with all laws and regulations. VocalEdge AI does not guarantee that the AI will convert leads, close deals, increase revenue, or produce any specific business outcome. The Client agrees that all results vary and that the Company is not responsible for the performance of the Client’s business.

The Client may cancel service at any time, but cancellation does not constitute eligibility for refunds or credits. The Client acknowledges that the Company may suspend or terminate service if the Client engages in abusive behavior, illegal activity, chargebacks, misuse of the system, or failure to pay. Continued use of the service after subscribing constitutes acceptance of all terms stated herein.

By subscribing to any VocalEdge AI product or service, the Client authorizes the Company to charge the payment method provided for recurring monthly subscription fees, service fees, or any additional charges associated with setup, usage, or plan upgrades. The Client agrees that charges will automatically renew each billing cycle unless canceled in advance. The Client acknowledges that they are responsible for maintaining a valid payment method, ensuring funds are available, and updating billing information as needed.

The Client understands that VocalEdge AI will only begin billing after verbal or written confirmation with a representative, but once billing begins, all charges are final. The Client acknowledges and agrees that they will not receive refunds, credits, reimbursements, or partial refunds for any payment processed. By allowing the Company to store and process payment details, the Client authorizes recurring charges until cancellation. The Client agrees not to dispute charges through their financial institution, as all payments are final and authorized.

The Client understands that failure to pay or removal of payment authorization may result in immediate suspension or termination of service, including the shutdown of the AI assistant, numbers, and integrations. The Client further agrees that VocalEdge AI reserves the right to pursue outstanding balances through collections or legal channels if payments are withheld after services have been rendered.

Continued use of the service constitutes acknowledgment of and agreement to all payment terms described in this Agreement.
